1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Halloween AI Filter mobile application (“App”), owned and operated by Awesome Mobile Software Ltd (“we”, “our”, “us”). By downloading, accessing or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Service Description

The App allows users to generate AI-powered images for entertainment purposes.

  • Free plan: Up to 3 image generations per 7-day period, with default settings only.
  • Pro plan (subscription): Up to 400 image generations per 7-day period, with full access to customisation options.

The App relies on third-party services (AIProxy and Google Gemini). Temporary downtime or errors may occur if these services are unavailable. This is expected and not considered a fault of the App.

⚠️ Failed generations: If an image cannot be generated for any reason (including provider downtime or safety filters), this does not count against your weekly quota.

3. Subscriptions and Trials

The App offers paid subscriptions (weekly with free trial, or annual). Subscriptions automatically renew unless cancelled through your Apple App Store account settings.

  • Cancellation & management: Subscriptions can only be cancelled, restored, or managed via Apple’s system (Settings on your iPhone).
  • Refunds: All refund requests are handled directly by Apple in line with their policies.

4. Availability and Limitations

The App is available globally, but Google Gemini may not be supported in certain countries. This can be tested with the free plan before subscribing.

Users are responsible for checking service availability in their region before purchasing. Using VPNs is at your own discretion.

AI services have safety filters (“guardrails”). Some images may be blocked (e.g. explicit or prohibited content). Occasionally, safe images may also be rejected due to false positives.

5. Acceptable Use

You agree not to use the App for:

  • Creating or attempting to create harmful, illegal, or explicit content.
  • Overloading the service or bypassing technical limits.
  • Reselling or redistributing generations outside personal use.

6. Disclaimer of Warranties

The App is provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or suitability for any specific purpose.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Any loss of data, profit, or business opportunities caused by use of the App.
  • Downtime of third-party providers (AIProxy, Google Gemini).
  • User misuse or inability to access the App.

Our liability is limited to the maximum amount you paid for the subscription in the last 12 months.

8. Governing Law and Jurisdiction

These Terms shall be governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England.

9. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you in the App or via the App Store. Continued use of the App means you accept the updated Terms.
